Overview of the California Probate Process
Most People Approach the Probate Process in a State of Confusion and Hurry. If a loved one of yours has died, and the heirs and or descendants suddenly realize that they know very little about the probate process of the deceased regarding assets you should contact an attorney.
What are the Steps for a California Probate Process?
The probate process always begins once the urgent family matters and funnel are held forth.
Once these family matters have been addressed, the probate process begins immediately based on two things:
- If there is a will
- Selecting a probate attorney
As your attorney, I will, efficiently and without delay, file all court documents and get the process going. I shall then meet with the executor appointed in the will along with the administrator designated by the California probate code.
What is the Purpose of Probate?
To the personal representative and rightful beneficiaries of an estate, There are three objectives to a California probate:
- Collection and management of the assets
- Payment of debts and taxes
- Distribution of the balance of the estate as required by the will and California laws
Who does what? The personal representative will have to find all the decedent’s assets, from monetary assets to personal and real property, necessary payments, all creditors, and a list of all potential beneficiaries.
As a probate attorney, I will prepare all legal documents, conduct legal filings, ask for authorizations and make court appearances. I will also handle the personal representative’s agenda. In addition; that publications are made, documents are filed, assets are transferred, and hearings are attended before the due date. I will counsel and support the personal representative with my experience and qualified advice in the process of paying creditors, managing the estate’s assets, paying taxes, and distributing the estate to the rightful beneficiaries. Of course; my role will also be to solve any conflicts, litigation, and claims that may appear within the process.
